Default or Non-Performance Clause

In the event that the client fails to comply with the terms outlined in this agreement, including but not limited to non-payment or failure to provide required access to the property, Alemy Property Restoration reserves the right to terminate services immediately. Any payments made prior to termination will not be refunded, and the client will be responsible for any outstanding costs incurred up to the date of termination.

Intellectual Property Clause

Any reports, plans, or documentation prepared by Alemy Property Restoration in connection with the services provided shall remain the property of Alemy Property Restoration until full payment is received. Unauthorized use, distribution, or reproduction of these materials without written consent is strictly prohibited.

Insurance Requirements

Clients are required to maintain adequate property insurance coverage throughout the duration of the project. Alemy Property Restoration may provide documentation to assist in filing insurance claims, but the client is solely responsible for obtaining coverage and securing approvals from their insurance provider.

Client Consent for Hazardous Materials

Clients must disclose the presence of hazardous materials (e.g., asbestos, lead, or mold) prior to the commencement of work. Failure to do so may result in project delays and additional costs. Alemy Property Restoration is not liable for damages or delays caused by undisclosed hazardous materials.

Privacy and Data Protection

Alemy Property Restoration complies with all applicable privacy laws in Canada. Any personal or property-related information provided by the client will be used solely for the purposes of fulfilling the services agreed upon and will not be shared with third parties without prior consent, except as required by law.

Indemnity Clause

The client agrees to indemnify and hold harmless Alemy Property Restoration, its employees, and subcontractors from any claims, damages, or liabilities arising from the client's negligence, failure to disclose pertinent information, or non-compliance with applicable laws or regulations.

Payment Terms

Payment Terms: 1. **Deposit Payment:** A deposit of 50% of the total project cost is required upon signing the agreement. Work will not commence until the deposit is received. 2. **Final Payment Deadline:** The remaining balance is due in full within 7 days of project completion. Failure to remit payment within this timeframe may result in late fees or suspension of services. 3. **Late Payment Terms:** Payments overdue by more than 30 days will incur a late fee of 2% per month (24% annually). Alemy Property Restoration reserves the right to pursue legal action for unpaid balances exceeding 60 days. A 5-day grace period will be provided for unexpected delays before late fees apply.

Refunds or Cancellation Policy

This deposit is non-refundable under all circumstances. 5. **Refund Process**: - Refunds, when applicable, will be processed within 7 business days of the cancellation request.
